(1) Under this paragraph, the authority that the mother and father can exercise over their sons and daughters, the responsibilities to be fulfilled and the duties to be followed shall be done jointly with the consent of both of them.
(2) Notwithstanding anything written in sub-section (1), in the following cases, the following mother or father shall have the authority to use, the responsibility to fulfill and the duty to follow in accordance with that sub-section:-
(a) In the event of the death of either mother or father, by the surviving mother or father,
(b) in the absence of one of the mother or the father at the domicile, the mother or the father being at the domicile for the duration of such condition,
(c) The mother or father who takes charge of the minor in case the marital relationship of the mother and father has ended or they live separately according to the law,
(d) In case of a minor whose father's address is not known, the mother.
